These Terms of Use apply to the Averagers mobile app ("Averagers", "the app"). The app asks you to accept them before first use. If you do not accept them, please do not use the app.
Averagers is a free tool that calculates, from your phone's GPS data, your current and projected average speed over a distance you choose, and shows whether the projected average is below or above the target you set. The app is operated by an individual operator, contact: [email protected].
Speed, distance, time and averages are calculated from GPS data, whose accuracy depends on your device, reception, tunnels, buildings and other factors. The data may be inaccurate or incomplete, is for information only, is not a certified measurement and is not a guarantee of anything. It can differ from measurements made by any official device.
Suggestions are based on settings chosen by other users. They do not indicate the legal speed limit, the safe speed, or the location of any traffic control.
To the fullest extent permitted by applicable law, the operator is not liable for any fines, penalties, traffic incidents, accidents, injuries or other damage arising from the use of the app, from reliance on its data, or from incorrect, delayed or missing data.
This limitation does not apply where the law does not allow liability to be excluded or limited – for example for damage caused intentionally or by gross negligence, or for harm to life, physical integrity or health. Your statutory rights as a consumer are not affected.
The app is provided "as is", free of charge. We may change, suspend or discontinue features (including community suggestions) at any time.
How the app handles data is described in the Privacy Policy.
If these terms change materially, the app will ask you to accept the new version before you continue.
These terms are governed by Hungarian law, without prejudice to mandatory consumer protection rules of your country of residence.
